STRIKE CRIMES
Attorney Bernard P. Bray has extensive experience handling strike cases as a three strikes lawyer, and has been successful at attacking strike priors on technical grounds, in persuading Prosecutors and Judges to strike priors for sentencing purposes, and in persuading Prosecutors and Judges to reduce qualifying felony charges to misdemeanors to avoid imposition of the Strike law where applicable.
In 1994 California voters passed the first three strikes law in the country. The law mandates that a person accused of a felony that has previously been convicted of any felony on a list of enumerated serious and violent felonies (strike crimes), is not eligible for probation, and must be sent to state prison on conviction of any new felony conviction. Persons previously convicted of two of the enumerated serious and violent felonies are subject to a 25 year to life prison term, the actual three strikes term.
